Employment and Industrial Relations
Employment legislation has become ever more complex and sophisticated in recent years. Very often the misinterpretation, misapplication or poor understanding of employment matters results in serious consequences for both employer and employee. We have acquired much experience in the handling of employment matters and disputes, primarily acting as legal counsel to various manufacturing and multinational companies.
We assist our clients in the drafting and formulation of employment agreements and policies, secondment agreements, agreements for reduced hours, termination/ settlement agreements, transfer of business undertakings and collective redundancies, as well as confidentiality and non-compete arrangements.
We also assist in understanding the basic conditions of employment, including the organization of working time (often regulated by industry specific wage regulation orders) as well as updating clients on various industry practices and norms, present locally and at European level. At the same time, we monitor the development and implementation of EU Directives affecting employment law issues.
We help our clients to analyse reported events of misconduct of employees or incidents of discrimination at the work place and strive to provide practical advice on the remedies that need to be adopted as a result. GVTH advises on trade union relations and collective bargaining, and has assisted in setting up employee representative bodies and works councils.
We represent clients in all types of employment litigation, mediation and dispute resolution at the Industrial Tribunal, Criminal Courts and various disciplinary boards, while keeping a watchful eye on the latest landmark case law and references emanating from both the local and European courts of justice.
